Many professionals need to be registered with an organisation or body specific to their profession. To maintain the registration there may be several prerequisites that must be satisfied by the professional. For example, they may be required to undergo supplementary training or education on a regular basis, they may not be permitted to have criminal convictions or convictions relating involving the misuse of funds, they may be required to meet the standards and expectations of a professional within the industry by way of Codes of Conduct and/or statutory guidelines.

If the professional’s conduct fails to accord with the standards and expectations of the industry, including if a finding of professional misconduct or unsatisfactory professional conduct is made against the professional by the organisation overseeing the industry, or another judicial body such as the NSW Civil and Administrative Tribunal, disciplinary action may be imposed against the professional. Available sanctions may include the issue of a reprimand, a monetary penalty, suspension from practice, restrictions on practice or deregistration. The type of disciplinary action imposed will depend on various factors including the nature of the allegations or complaint against the professional, any prior adverse findings against the professional, the decision maker, the sanctions authorised pursuant to the profession’s Code of Conduct and/or statutory guidelines and the likelihood of future breaches.

If the decision has been made to suspend the professional’s licence, it will prevent the professional from working in their field for a predetermined period of time. There may be grounds for an appeal to be lodged however time limits will apply so it is important to seek legal advice immediately.
