Broadly speaking, if you are disqualified from driving (that is, the Court has disqualified you from driving), you must not drive any motor vehicle on a road, or on a road related area whilst the period of disqualification is in effect. Further, if you are disqualified from driving you must not apply for a drivers licence during the period of the disqualification.
If you are found guilty and convicted of the offence of drive while disqualified, the court will generally disqualify you from driving and holding a drivers licence for the mandatory period set by the legislation and any further disqualification period as the court may order. In general terms, the mandatory disqualification period is the minimum period that the court can disqualify you for if you are found guilty and convicted of this offence.
The maximum penalties for the offence of drive while disqualified are:
- A maximum fine of $3,300,
- A minimum or mandatory disqualification period of 12 months,
- An unlimited disqualification period as a maximum,
- A term of imprisonment of up to 18 months.
