In general terms, an Appeal is an application to a higher Court to have a decision reversed. However, an Internal Appeal is an application to the body that made the initial decision to have that decision reversed.
The NSW Civil and Administrative Tribunal, herein after NCAT, has an Internal Appeal Panel which allows parties to appeal or seek permission or ‘leave’ to appeal a decision of the tribunal. The NCAT Appeal Panel will generally hear decisions made from various NCAT divisions, such as, the Administrative and Equal Opportunity Division, the Guardianship Division, the Occupational Division, the Consumer and Commercial Division and further appealable decisions.
However, depending on the circumstances, there are some decisions that cannot be Internally Appealed to the NCAT Appeal Panel. In some instances, where an Internal Appeal is not appropriate there may be various avenues to apply to have a decision appealed.
