The Roads and Maritime Service (formerly the RTA) generally notify you if your licence is to be suspending by sending you a Notice of Suspension in the mail. The notice of suspension should set out when the suspension of your licence is to begin. If you receive a letter from the RMS (formerly the RTA) and you wish to appeal the suspension of your drivers licence you will need to lodge the appeal within 28 days of receiving the notice of suspension. Generally, you can either complete the court election form on the back of the notice of suspension or you can attend the local court registry to file your appeal against the decision of the RMS (formerly the RTA) to suspend your licence.
The Local Court will hear your RMS appeal (RTA Appeal) and generally make a decision at that time on whether to allow your appeal (usually meaning you can keep your drivers licence),or disallow the appeal (meaning the RMS decision is confirmed) or in certain circumstances the court can reduce the suspension period (meaning you will be suspended, but for a shorter amount of time than what was indicated on the notice of suspension).
If you wish to lodge an appeal against a decision of the RMS (formerly the RTA) we recommend you speak with one of our traffic lawyers to advice you on the merits of your RTA appeal. We can advise you whether you have reasonable prospects of success in your appeal and help prepare you for your attendance in court. If you would like to meet with one of our traffic lawyers to dicuss your RTA appeal, you can call us on (02) 9233 4048 or send an email to info@navado.com.au and arrange an appointment.
