Insurance Contracts are primarily controlled by the Insurance Contracts Act 1984. The terms of the Act generally regulate:

  • The Duty of the Utmost Good Faith;
  • Insurable Interests;
  • Disclosure obligations;
  • Contractual standards;
  • Claims;
  • Expiration, Renewal, Cancellation;
  • Subrogation; and
  • Information; Notices and Reasons.

Additional to the provision of the Insurance Contract Act, it may also be the case that the terms of the Australian Consumer Law and Contract Review Act 1984 apply. At Navado, we may be able to advise you as to whether your insurance contracts comply with the applicable laws and how any noncompliance may be rectified together with representing you in any proceedings arising from noncompliance. Alternatively, if you are a consumer who has entered into an insurance contract which you suspect contravenes the law, we can advise you as to whether a breach has occurred and the rights, if any, that you have available to you.
