Professionals have standards of conduct which are prescribed by law and/or are set out in Codes of Conduct issued by a professional organisation. If a patient or client has a concern about the conduct of the professional, they may be able to lodge a complaint with the professional organisation or a governmental department such as the Ombudsman.

Each professional organisation and government department has their own procedures for dealing with and managing complaints. Typically however, once a complaint is received, it will decide whether or not an investigation should be initiated against the professional. If so, the professional will be given an opportunity to respond and defend the complaint. Any submissions made by the professional should be taken into consideration during the investigation and determination process, pursuant to the principles of procedural fairness.

Prior to responding to a complaint, it is advisable that you firstly obtain legal advice as to whether you have a case to answer and your legal standing. Our team at Navado can assist you during the complaints process, from advising, drafting submissions through to legal representation. We will also be able to advise as to whether you are at risk of a civil claim being made by the complainant or another party, and how your submissions and the outcome of the investigation may affect any future legal proceedings that may be brought against you.
