Legally, a person may be considered mentally ill if they suffer from a Mental Illness. Pursuant to the Mental Health Act, Mental Illness is defined as a condition that seriously impairs the mental functioning of a person. The serious impairment may be temporary or permanent, and may be characterised by one or more of the following:

  • Delusions;
  • Hallucinations;
  • Serious disturbance of thought;
  • Severe disturbance of mood; and/or
  • Sustained or repeated irrational behaviour (indicating one or more of the abovementioned characteristics).

In addition to the above characteristics, there must also be reasonable grounds for believing that the individual requires care, treatment or control in order to:

  • Protect the person from serious harm; or
  • To protect others from serious harm.
