In respect to Mental Health Law and Medical Law the Courts may make orders for a person(s) to complete specific treatments, be monitored and/or assessed by hospitals, doctors or other medical professions. For example, the Courts may make a Community Treatment Order whereby the named person must receive compulsory treatment or an Involuntary Patient Order whereby a person is ordered to stay for a period of time at a mental health facility.

In some instances, orders may be extended by way of an application to the Court or the Tribunal. The application may be made by the person named under the Order, or a third party. However, the applicant must explain and provide valid reasons as to why an Order should be extended.

Generally, the final decision to extend an order is made by the Court or Tribunal. In deciding whether to extend an Order, the following matters may be considered:

  • The type of Order previously made;
  • The health and wellbeing of the patient;
  • Whether the patient has a lengthy history of mental illness with repeat admissions;
  • Whether the patient is the applicant requesting the extension of the Order;
  • Whether the patient was present at the hearing;
  • The severity of the illness; and
  • The age of the patient.
