The Mental Health Tribunal is a Government body in New South Wales, constituted under the Mental Health Act 2007. The main purpose of the Mental Health Tribunal is to hear appeals, make orders, review orders and conduct mental health inquiries.

There are various locations across New South Wales where the Mental Health Tribunal can conduct hearings including Sydney, Wollongong, Newcastle, Goulburn and Orange. Hearings at the Tribunal of often held in hospitals and community health centres.

The Mental Health Tribunal has specific jurisdiction across numerous matters. Generally, the Mental Health Tribunal conduct Civil and Forensic hearings. Broadly speaking, some matters in which a hearing may be held include but are not limited to;

  • Making and revoking Community Treatment Orders;
  • Refusal to discharge patients;
  • Make and authorise Involuntary Patient Orders;
  • Review Involuntary Patients;
  • Review Voluntary Patients;
  • Review cases involving persons found to be unfit to stand trial for a criminal offence;
  • Review cases involving persons to be found not guilty by reason of Mental Illness; and
  • Review patient transferred.
