A strata dispute involves a dispute about a strata scheme and the exercise of its functions. Some common disputes include disputes about:
- The general maintenance of, and repairs to common property;
- Decisions about allowable works to a lot within the strata scheme;
- The enforcement or operation of by-laws eg parking, the keeping of pets;
- Abuse of power within the strata scheme;
- Debts incurred.
Where there is a strata dispute, alternative dispute resolution options are required if a party wishes to bring proceedings in the NSW Civil & Administrative Tribunal ("NCAT") . Prior to being able to make an application with NCAT, the parties must have first attempted mediation. Mediation involves an independent mediator facilitating discussions between the parties in an effort to assist them in reaching a resolution.
If mediation is unsuccessful, an application can then be filed and an adjudicator will subsequently determine the outcome of the application. An avenue for appeal may apply against an adjudicator's decision.
