Expert determination is a type of alternative dispute resolution ("ADR") process. It involves the parties to a dispute agreeing to engage an independent expert to assist them in reaching a resolution of the dispute. If the expert does not otherwise have its own designated procedure and rules about how to conduct an expert determination, they must follow those prescribed by the Law Society of NSW.
Expert determinations offer an informal approach to dispute resolution. It involves each party lodging details of the dispute, relevant documentation/ evidence and submissions to the expert and attending a preliminary conference to discuss the dispute. The expert will then have up to three months to issue their determination which will finalise the dispute. The determination will be binding unless the parties agree otherwise.
