Credit disputes can a variety of disputes including those about:
- Existing or prospective lines of credit;
- Credit ratings;
- Defaults registered under a company or individual's credit report.
Where there is a credit dispute, alternative dispute resolution processes can be implemented and in some instances, are necessary. For example, a credit dispute lodged with the Credit & Investment Ombudsman will be referred for conciliation in an effort to resolve the dispute. In other matters, particularly those regarding a credit report, negotiation may be the most appropriate action.
If a credit dispute is the subject of legal proceedings, the Court/ Tribunal can still refer the dispute to another type of alternative dispute resolution, mediation. Mediation is a more formal process than conciliation and the mediator assumes a more active role in liaising with the parties about their competing views and often provides their own independent assessment of the dispute to assist in a resolution being reached.
