- whether the dispute is governed by domestic or international law;
- whether there are any previous cases which have dealt with a similar dispute, and the outcome of these cases. Case law is of particular importance to cyber law/internet matters where a dispute relates to subject matter that has not yet been incorporated into, or appropriately considered by the applicable legislation.
