The majority of environmental disputes we see involve development applications lodged with a local council. Common disputes include disputes concerning:

  • The conditions attached to development approval;
  • The rejection of a development application;
  • The implications of a pending development on a neighbor or a locality, for example- noise, traffic, deprivation of privacy and sunlight;
  • The zoning of a property and permitted uses.

Where a local council has made its' decision, an interested party may be able to commence legal proceedings in the Land and Environment Court seeking an appeal of Council's decision or some other available order, eg compensation. During this process, one of the stages is for the parties to participate in conciliation.

Conciliation is an alternative dispute resolution mechanism involving a third party, a conciliator, speaking with the parties and trying to assist them in obtaining a resolution of the issues in dispute. In most cases, it is only after conciliation that a matter will advance to a final hearing where a judgment will be handed down and the parties will be bound by those orders (subject of course to any right of appeal).
