Defamation is where the reputation of a company or individual is negatively affected by someone publically sharing a false statement/ image about them. An example of defamation is a news article falsely alleging a person is involved in a criminal act or that a company is engaging in illegal work practices.
The main institution that is regulated by the laws of defamation is the media, however, it also applies to members of the public who engage in such conduct.
Where there is a defamation dispute, the individual or company affected may seek to obtain a public retraction of the false statement/image, an apology, a guarantee that the defamatory conduct will not reoccur together with compensation for loss the individual or company has sustained because of the defamation. Two of the primary types of loss includes the loss of reputation within the community and financial loss.
Where there is an allegation of defamation, litigation is an available option however, so too are alternative dispute resolutions ("ADR") such as negotiation, conciliation and mediation. In these types of matters it is common for the offending party to be willing to partake in ADR to avoid the publicity they would likely receive if the matter went to Court and to try to expedite the resolution of the dispute.
