The Privacy Act defines personal information as ‘information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual, or an individual who Is reasonably identifiable’. The Privacy Act 1988 (Cth) stipulates rules to be followed in respect to the collection, storage, use and disclosure of personal information.
Some examples of personal information include but is not limited to:
- Name;
- Address;
- Telephone number;
- Date of birth;
- Medical and health records;
- Bank account and other financial records;
- Tax file number.
With respect to medical information, there are specific laws surrounding the collection and use of these records. Some organisations that may collect and/or use our medical information include:
- Local medical practices;
- Hospitals;
- Medical Practitioners, such as, Doctors, Psychologists, Chiropractors, Gynaecologists, amongst others;
- Pharmacists; and
- Exercise and weight loss facilities.
The abovementioned facilities and health care professionals may collect and use our personal medical records to diagnose, treat and monitor our health and wellbeing. Our medical information is private and confidential and should only be accessible to appropriate persons.
If there is an unauthorised use of our medical records, the facility or health care professional may be in breach of privacy laws and relevant codes of conduct.
