Doctors have a duty of care to their patients, that is, a legal duty to care for their patients and to act in their best interests. Generally, the role of a doctor is to examine, diagnose, treat and advise their patients.
If a doctor breaches their duty of care, their patients may suffer direct or indirect loss as a result of the doctor failing to meet the standard of care expected (this is called negligence). Some examples of negligence include:
- Failure to obtain valid consent;
- Failure to obtain an appropriate history from the patient;
- Misdiagnosis;
- Infecting a patient from unsanitary procedures;
- Medication or treatment errors;
- Premature discharge of a patient;
- Sexual misconduct;
- Equipment failure;
- Injuries or death resulting from procedures, treatments or misdiagnosis.
The abovementioned list is not exhaustive and there may be many other actions or situations that could be classed as doctor negligence.
Doctor negligence does not exclusively refer to your local General Practitioner (GP) but also includes;
- Surgeons;
- Neurologist;
- Gynaecologist;
- Obstetrician;
- Plastic Surgeon;
- Radiologist; and
- Various other medical specialists.
