A Community Treatment Order (CTO) is an order made by the Mental Health Review Tribunal or a Local Court which orders a person in the community to receive compulsory medical treatment. These orders can be enforced for up to twelve (12) months and possibly renewed once a person has completed their treatment.
Generally, if a person has made a CTO application against you and the order has been granted, then you are expected to comply with the order and receive compulsory treatment for the ordered period of time. In some instances, the CTO application may be heard in Court in your absence.
At Navado, we understand that this may be a complex situation to understand. Our Mental Health Lawyers are able to provide you with professional legal advice to assist you with understanding your situation and help you develop appropriate ways to resolve your matter.
If a CTO Application has been made against you, you may have the ability to Appeal the Order to the Mental Health Review Tribunal and/or relevant Court. Our Mental Health Lawyers can assist you with preparing your Appeal Application and/or representing you in Court.
Similarly, if a CTO Application has been granted against you, and you do not comply with the Order there may be a range of possible outcomes. These outcomes may impact you negatively, such as, being forcefully treated, or being assessed for involuntary admission to a mental health facility, amongst others. Therefore, it is recommended that you speak with a Mental Health Lawyer to ensure your situation is handled in your best interests.
If you wish to Appeal a CTO Application or you have not complied with your CTO and are seeking legal advice, please contact our firm by telephone on (02) 9233 4048 or send an email to info@navado.com.au.
