Child support generally takes the form of an agreement between parents on the amount of money to be paid for the support for the child. It is advantageous for all parties involved if the agreement is made consensually. Where parents do not agree, the Child Support Agency will get involved and make the decision. Under the law, both parents have a duty to support their children. From 1 July 2009, parents who were in a same-sex relationship may also have a duty to support their children financially. Child support is generally calculated with consideration of various factors including but not limited to:
- Income of both parents;
- The number of children each parent will be supporting (whether from previous or future relationships);
- The cost of raising children of different age groups; and
- The amount of time being spent with the children.
Child support is generally not available once the children reach the age of eighteen (18). However, where the child is continuing education or is suffering from a mental illness, it may be possible to apply for continuing child support. An application will need to be lodged with the court. - You are thinking about entering into an agreement affecting your future rights with your children;
- You are concerned about a decision made by the Child Support Agency; and/or
- You have a dispute with Centrelink regarding child support.
