A contract can vary from one area of law to the next and contracts relating to the media and entertainment industries are no exception.
Pursuant to the relevant case authorities, dispute resolution clauses in some standard form contracts may be unenforceable if subject to judicial scrutiny. As a result of the potential enforceability issues and the ambiguity associated with standard form contracts, Standards Australia has expressed an intention to review all dispute resolution clauses within its current suite of contracts.
It is definitely an ambiguous time for our clients who do not know whether Dispute Resolution Clauses are enforceable or whether the current contractual Dispute Resolution Clauses will become un-enforceable. Our media lawyers can help.
