A person living with a disability who has become a participant under the National Disability Insurance Scheme (“NDIS”) can seek to have a Nominee appointed. Nominees have the duty to ascertain the wishes of the participant and make decisions on the participant’s behalf. Any decisions made by a Nominee must aim to maximise the personal and social wellbeing of the participant. A Plan Nominee is a Nominee appointed specifically to assist in managing the preparation, review or replacement of the participant’s plan and/or manage the funding received by the participant.
The NDIS has a set of rules which sets out who can be appointed a Nominee and the expectations of the Nominee.
