The National Disability Insurance Scheme (“NDIS”) is a national system for the provision of support and assistance to people with disability, their families and carers implemented under the Federal National Disability Insurance Scheme Act 2013 (“the Act”). The primary objects of the Act are to reflect Australia’s international obligations under various international conventions, to assist those with a disability to live independently within the community, to provide the necessary support for those with a disability (such as early intervention programs) and to protect those under the NDIS from harm arising from poor quality support and assistance.
People with a disability have the same right as other everyone else to determine their best interests and to have choice and control over their lives. The NDIS acknowledges that everyone’s needs and goals are different. The NDIS provides people with individualised support and flexibility to help them achieve their goals and improve their quality of life. The NDIS is an insurance scheme which takes a lifetime approach.
To gain access to NDIS, you will need to meet the criteria and request to become a participant. People who meet the NDIS access requirements are referred to as participants. When you become a participant you are entitled to receive funded supports and an individual plan. Generally, the access requirements include the availability of the scheme where you live, your age, your residency status and your disability.
We can assist you in applying under the NDIS and advising you on any criteria issues. In some cases the NDIA may request more documents, assessments or evidence. We recommend you seek legal advice and guidance to ensure you make a valid request.
