Privacy law relates to the protection of an individual’s personal information. Personal information refers to information that identifies you or could reasonably identify you.
The NSW Information and Privacy Commission undertakes the privacy functions conferred by the Privacy and Personal Information Protection Act 1998 (NSW) and Health Records and Information Privacy Act 2002 (NSW).

The Office of the Australian Information Commissioner (OAIC) deals with issues that are covered by the Privacy Act 1988 (Privacy Act), which regulates the handling of personal information by Australian, ACT and Norfolk Island government agencies, and certain private sector organisations. There are refined and particular aspects of privacy that are not dealt with by the OAIC.
The purpose of the Freedom of Information (FOI) legislation is to facilitate access for individuals to government information. Under the Freedom of Information Act 1982 (FOI Act) you may, within the parameters of the legislation (excluding exceptions), access certain documents possessed by government state and federal agencies.
The FOI Act deals primarily with the publication of specified information, and provides guidelines concerning the general right of access to documents of agencies and official Ministerial documents, subject to certain exceptions and exemptions. It also provides an avenue for individuals to amend certain personal information and supports a system for the review of decisions on requests.
The FOI Act gives any person the right to:
- Access copies of documents (except exempt documents);
- Ask for information about you to be changed or annotated if it is incomplete, out of date, incorrect or misleading; and
- Seek a review of our decision not to allow you access to a document or not to amend your personal record.

Our Lawyers can also advise on what may be an ‘exempt document’ pursuant to the exemptions set out in the FOI Act.
