Property Valuation disputes or Business Valuation disputes can arise in various circumstances, and may involve complex proceedings in which expert witnesses may be needed to establish relevant factual matters.
Some situations where property valuation or business valuation disputes can occur include the following examples:
- An individual or business is embarking on a commercial enterprise and requires a valuation of assets to quantify and measure its wealth for risk assessment;
- A business or individual is going through the complex process of breaking up a partnership or other commercial arrangement and needs to quantify its wealth before the breakup and separation; or
- An individual is assessing matrimonial property before separation.
Other examples where property valuation disputes or business valuation disputes may eventuate include cases that involve shareholder disputes, bankruptcy, minority shareholder operation, post transaction and merger & acquisition disputes, distribution of assets and estate property, disputes concerning loss of business value issues, fraudulent conveyance and commercial litigation.
Valuation in family law disputes commonly involves the assessment of property value which may or may not be the subject of a pre-nuptial agreement. Before any such agreement can be made, a valuer may be required to assess the property value so that it is correctly identified and described in the deed.
A business valuation can involve a situation where two individuals or companies engage in a common enterprise for a period of time, but later wish to terminate their relationship. In this case, a valuer may be needed to assess exactly how much value is attributed to certain aspects of the business, so that the dispute may be able to be fairly resolved.
