Environmental impact assessment, like species impact assessment, is a process that needs to be undertaken before the commencement of certain development projects. A “statement of environmental effects” (ESS) accompanies development applications that fall under the categories of:

  • Complying Development;
  • Advertised Development; and
  • Integrated Development.

An “environmental impact statement” (EIS) on the other hand, is required in development applications (under Parts 3A, 4 and 5 of the Environmental Planning and Assessment Act 1979 (NSW)) that fall under the categories of:

  • State Significant Development; and
  • Designated Development.

The Environmental Planning and Assessment Regulations outline the matters that must be addressed in the EIS.

Other issues of concern to Developers

A liability may arise for developers who acquire land formerly used for a purpose involving hazardous waste and who wish to develop the land for another purpose such as a childcare centre. For more information, see our “Contaminated Land Management and Remediation” section.
