Australian native species are protected by various regulatory mechanisms so that over-development does not threaten their survival or habitat. Native animals can be declared protected species under section 98 of the NSW National Parks and Wildlife Act 1974 (NSW) or an endangered species under the provisions of the Threatened Species Conservation Act 1995 (NSW). A reserve, which is classified as “community land” can be created under the Local Government Act 1993 (NSW) for the purposes of allowing certain protected native species to breed in their habitat. A programme can be put in place that monitors the status of a threatened or endangered native species and its habitat, including periodic population counts, egg and nest removal or inspection, egg oiling and roost dispersal, weed harvest and monitoring, replanting, soil remediation, on-site burial for deceased species, and other matters.
