The Local Court is the “front line court” for most civil and criminal cases in New South Wales. It hears most of the summary criminal cases and civil disputes where the claims are not over $100,000. Appeals from the Local Court go to the District Court. The following list provides a general description of the types of cases that may be heard by the Local Court:

  • Civil disputes:
    • Small Claims Division,
    • General Division,
    • Disputes over loans,
    • Disputes over unpaid bills,
    • Damages for motor vehicle accidents,
    • Claims for the return of property,
    • Disputes relating to services paid for by not provided.
  • Criminal litigation:
    • Summary offences,
    • Committal hearings for a determination relating to indictable offences to be heard in a higher Court (either the District Court or the Supreme Court, depending on the nature and type of criminal offence).
  • Bail applications (criminal matters):
  • Apprehended violence orders (criminal matters):
  • Family law cases:
    • Property settlement disputes,
    • Residence Orders.
  • Disputes relating to determinations of the Roads and Transport Authority.
  • Annulment applications.

The benefit of retaining a solicitor who works in a diverse litigation team and across many different civil and commercial litigation matters may be that the solicitor will have a host of resources available at hand to deal with your dispute.
