Employment Disputes:

Overview FAQs Articles Locations

Employment disputes can arise in any number of situations. A commercial litigation solicitor may benefit from experience gained in dealing with civil litigation matters because having this broader experience will ensure a broader perspective in terms of possible defences, counter-claims and potential negotiated resolutions. Any given employment litigation matter will likely be based on various provisions of the employment contract. The contract will contain provisions which facilitate or allow termination, suspension or some other type of penalty. Where these are disputed, the general principles of contract law may become highly relevant. Of course, contracts in the employment context will have specific terms and conditions, many of which may be mandated by statute.

Be that as it may, it is not unusual for a dispute in the employment environment to arise because of some other supervening issue or problem. Where there is an unjustified termination of a contract, this may be the result of the employee failing to concede to demands placed on him by an employer, where those demands are unreasonable, contrary to the employment contract, or otherwise unlawful or illegal. Issues pertaining to harassment and discrimination may also appear within a dispute concerning an employment arrangement.

Employment dispute solicitors who have at their disposal resources from a wide variety of litigation practice areas will be best suited to exploring these other areas of litigation. Employment dispute lawyers that have been exposed to and have dealt with both civil litigation and commercial litigation will have the skills and knowledge base to explore all the legal options and alternatives which can be relied upon to build an effective and strong case.

Litigation is costly and time consuming. Sometimes, that alone can prevent a potential litigant from pursuing a case. However, proper employment dispute legal advice should first be obtained before any decision is made in relation to progressing or dropping a matter. In some cases, it might be more costly in the long term not to prosecute or defend a case vigorously. Legal advice from our civil and commercial litigation lawyers will be comprehensive and is a good basis on which to make a determination of future action. The dedicated team at Navado which has experience from different areas of litigation understands that what might be seen at first glance as a simple dispute may involve multiple claims and multiple heads of damage.

Our “Employment Law & Safety Law” section offers further information which is specific and particular to employment claims. Visitors are welcome to browse that section for further details before arranging a preliminary conference with one of our civil or commercial lawyers.
