The registration process of medical practitioners is essential to be able to practice as a doctor within NSW. When seeking to apply, you will need to ensure that you have obtained all the information relevant to your application. For example:

  1. You will need to disclose your criminal history such as if you have been charged with an offence punishable by imprisonment for at least 12 months, or if you have been convicted of an offence that is punishable by imprisonment. AHPRA will check your criminal history to ensure that you are a suitable candidate for registration.
  2. You will need to demonstrate proficiency in the English language.
  3. You will need to provide evidence of securing Professional Indemnity Insurance.
  4. You must satisfy your Continuing Professional Development requirements.
  5. You must have completed a certain number of practice hours.

Once an application has been received by the Medical Board of Australia, they will conduct an assessment of the information provided against the relevant standards. At this stage additional information or testing may be required to facilitate the assessment process. The application may be approved by a Delegate of the Medical Board of Australia in some instances, or otherwise it will be referred to the Board for further consideration and an ultimate determination of your application.

If your application is rejected, you may be able to lodge an appeal with the NSW Civil and Administrative Tribunal (“NCAT”).  Similarly, if a decision has been made not to renew your registration or if conditional registration is granted, an avenue for appeal may also exist to NCAT. At NCAT the Members will consider the evidence presented at hearing by both the appellant medical professional and AHPRA. Upon the conclusion of the hearing, a decision will be made to affirm, substitute or vary the original decision of the Medical Board of Australia. If you are still unsatisfied with the determination made by NCAT, an external appeal may be available in some circumstances.

This process is similar for other medical professionals including psychologists, midwives, physiotherapists, podiatrists and other professionals working within this industry. The main difference is the relevant Board to which the application for registration is lodged and additional information or criteria may need to be met for your application.

If you are in dispute about your registration, or if you have received an unfavourable decision, we recommend that you seek advice from a member of our team. We can work with you to understand your complaint and try to resolve the issue with the relevant Board or AHPRA, or if you have been unsuccessful with your application, we can provide legal advice about your avenue for appeal and prospects of success.
