An Apprehended Violence Order (“AVO”) sets out prohibitions and restrictions on the conduct and movement of a person against whom the order is made, called the Defendant. These prohibitions are made for the protection of another person’s safety, known as the Protected Person.

Such prohibitions may include orders preventing the Defendant from:

  • Assaulting, molesting, stalking, intimidating, harassing, or otherwise interfering with the Protected Person;
  • Approaching the Protected Person;
  • Accessing the Protected Person’s residence, workplace or another specified premises;
  • Approaching the Protected Person or any place within 12 hours of consuming alcohol or illicit drugs;
  • Carrying a firearm;
  • Damaging property owned by the Protected Person; and
  • Any other conduct necessary for the protection of the Protected Person.

A breach of any prohibitions prescribed by an AVO is a criminal offence, punishable by fine and/or imprisonment.

If you require assistance with an AVO matter, please arrange an appointment by telephone on (02) 9233 4048 or email info@navado.com.au to see one of our AVO Solicitors.
