An Apprehended Violence Order (“AVO”) is an Order made following the filing of an application to the Local Court. An AVO is issued to protect the wellbeing and safety of a “Protected Person” from the “Defendant” by establishing prohibitions and restrictions on the Defendant’s conduct and their contact with the Protected Person.

When an application is made to the Local Court, the application will be assigned a date and time on which it will be reviewed. The defendant will receive notification of the application and the impending Court date.

On the first listing date, the Defendant will have an opportunity to consent or object to the application. If an objection is made, the Court will list the matter for mediation or final hearing. If the case proceeds to hearing, the parties will present evidence in support of their case in support of the application or in defence of the application and the allegations raised by the Protected Person.

Once the evidence is heard, the Court will consider whether to:

  • Dismiss the Application. This means that an AVO will not be granted; or
  • Grant the AVO and impose conditions it considers reasonably necessary and appropriate in the circumstances for the safety of the Protected Person.
