Nuisance Dog Orders:

A nuisance dog is a dog that is:

  • Frequently escaping;
  • Persistently noisy;
  • Constantly defecating on other properties;
  • Chases other animals, people or vehicles; or
  • Repeatedly causes substantial damage.

If an authorised officer of the Local Council considers a dog to be a nuisance, the officer must first provide a notice to the owner explaining:

  • The obligations of the owner if a ‘nuisance order’ was to be made;
  • The owner’s right to object to the making of a nuisance order within 7 days.

 If you have received notice from the Local Council indicating that a nuisance order may be made, we recommend that you seek immediate legal advice on the submission of an objection because once the 7 days have elapsed, no further recourse will be available to you.

If the authorised officer elects to proceed with the making of the nuisance order, it will be final, that is, it cannot be appealed or reviewed. A nuisance order will be operational for a period of 6 months.  If an owner does not comply with the order, they are guilty of an offence and a fine may be issued by the Local Council.
