The Land and Environment Court of New South Wales (herein “the Court”) was established on 1 September 1980 by the Land and Environment Court Act 1979 (herein “the Act”).

The Court’s jurisdiction includes merits review, judicial review, civil enforcement, criminal prosecution, criminal appeals and civil claims about planning, environmental, land, mining and other legislation.

We are commonly approached by clients who wish to construct a detached single dwelling or dual occupancy (including subdividing the two dwellings), or to alter or add to a dwelling or dual occupancy. Usually, our clients will need to apply to their Local Council for development consent which they must obtain before carrying out the works. When consent is refused by the local council the person may appeal to the Land and Environment Court.

At Navado, we may be able to assist with construction related appeals when an application for consent has been refused. Appeals are generally made under s 97 or s 97AA of the Act and residential development issues are resolved through a special, streamlined process under s 34AA of the Act. The aim of the Act is to ensure that construction related appeals are dealt with qucikly and justly.
