The Freedom of Information Act 1982 gives any individual the right to access documents held by the Department of Human Services, request information be amended and/or to seek a review of a decision by the Department of Human Services to prevent you from accessing or amending a document.
An individual may exercise the above rights through a request made to the Department of Human Services, in writing, detailing the information requested under the Act and providing an address for any reply. It is noted that there is no application fee for an FOI request. Generally, the Department of Human Services indicate that a response to any application will be provided within 14 days from the date on which an application in received.
Should you disagree with any decision relating to your application, you are able to review the decision via an internal review process or through the Information Commissioner. Please note that time limits are applicable to both review processes.
Should you require any documents in any proceedings that are subject to an application under this Act, we recommend that any application be made at the earliest possible stage in order to avoid any delay in your legal matter. Advice should be sought on any application made to the Department of Human Services.
