In New South Wales, the Interlock Program is a Court based penalty for drink drivers. The Interlock Program gives drivers who are convicted of certain alcohol related traffic offences the ability to continue driving after they have completed a reduced disqualification period and the driver obtains an interlock drivers licence to participate in the interlock program.

Who is eligible to participate in the Interlock Program?

Generally, the Court decides who is eligible to participate in the interlock program.  If the Court decides to allow a person to participate in the Interlock Program, the Court issues two orders in relation to the offending person.  Generally, the first Court order will set out the full disqualification period for the offence that has been committed.  The second Court order usually specifies:

  • The reduced period of disqualification (known as the 'disqualification compliance period');
  • The interlock program participation period where the driver holds an interlock drivers licence and will be subject to certain conditions.

Whilst the Court can recommend that you participate in the Interlock Program, participation in the Interlock Program is voluntary.  If you do not obtain an interlock driver licence from the Roads and Maritime Services, you will generally be required to serve the full disqualification period that you have been sentenced to.

What is an interlock device?

In general terms, the interlock device is an ‘electronic breath-testing device’ connected to the ignition system of your vehicle.  With the interlock device connected to the vehicle, your vehicle will not start unless you pass a breath test. Therefore, your vehicle will not start if you have been drinking.
