Generally, GST is payable by the vendor if the sale of the property is a taxable supply. What constitutes a taxable supply is defined by the A New Tax System (Goods and Services Tax) Act 1999. Of course, there are circumstances under which a taxable supply is GST free or where GST is not payable due to an exemption. Note that although it is the vendor who incurs the GST liability, sometimes this is passed onto the purchaser through the Contract.
