A Financial Manager, also known as a Property Manager or Estate Manager, may be appointed to manage a person’s financial affairs. Generally, a Financial Manager will be appointed in circumstances where there is a dispute between family members and/or care-givers regarding the financial affairs of an incapable individual, where that incapable individual may need to engage in legal proceedings and require a Financial Manager to sign documents on their behalf.
The Guardianship Act 1987 and NSW Trustee and Guardian Act 2009 authorise the Guardianship Division of NCAT to make Financial Management Orders in such matters.
In some instances, you may believe that a person(s) who has been appointed as Financial Manager may be unsuitable and may not be able to fulfil the Financial Managers’ responsibilities. Therefore, if you have a genuine concern for the welfare and financial status of the protected person, you may be able to apply for the Review or Revocation of a Financial Management.
If you are looking to request a Review or Revocation of Financial Management, it is important to seek legal advice from a Guardianship Lawyer. At Navado, our team of Guardianship Lawyers can discuss, in a confidential environment, whether you are an eligible person to apply for a Review or Revocation of Financial Management, the grounds with which you wish to make the application for a Review or Revocation of Financial Management and any rights or obligations you may have surrounding your application to request a Review or Revocation of Financial Management.
Furthermore, if you are eligible to request a Review or Revocation of Financial Management, our Guardianship Lawyers can assist you throughout the application process and, if necessary, represent you in the Guardianship Division in NCAT.
On the other hand, should your Financial Management be subject to a Review or Revocation, our team of Guardianship Lawyers can provide you with professional legal advice in relation to your rights and obligations as Financial Manager and determine any strong and/or weak points in your case.
If you wish to speak with one of our Guardianship Lawyers regarding a Review or Revocation of Financial Management, we invite you to contact our Sydney CBD Head Office by telephone on (02) 9233 4048 or send us an email at email@example.com.
