Awards are legal instruments that set out the minimum conditions of employment which must be adhered to by an employer. Whilst they differ from one Award to another, they generally cover the following topics:
- The grading of employees;
- Salary structure;
- Leave entitlements including annual leave, personal leave, parental leave, long service leave and study leave;
- Allowances such as public holiday loading, penalty rates, travel, and meal allowances;
- Performance reviews and promotions;
- Termination of employment;
- Redundancy;
- Work, health and safety matters.
There are different Awards for different industries, jobs and different employers including Crown and public sector employees such as teachers, fire fighters, legal officers, police officers, health care professionals such as nurses and doctors working in public hospitals, correctional officers and ambulance officers. Awards also exist for employees of certain companies.
An Award often operates alongside an employment contract and workplace policies, which together regulate the employment relationship. If there has been a breach of an Award by an employer, then the employee may be entitled to make a claim to the NSW Industrial Relations Commission or other judicial body.
