The Australian Competition & Consumer Commission (“ACCC”) enforces the provisions of the Competition & Consumer Act ("the Act") as well as the Australian Consumer Law (“ACL”) that is a part of the Act. The ACCC aims to promote fair trade and competition within the marketplace and offer consumer protection.  

The ACCC has the power to: 

  • Investigate alleged breaches of the Act; 
  • Initiate compliance and enforcement action such as: 

-          Educating businesses and consumers

-          Encouraging voluntary compliance initiatives

-          Administrative resolutions which may include the supplier or service provider agreeing not to contravene the Act again or to cease certain conduct; 

-          Infringement notices for a breach

-          Section 87B enforceable undertaking. This is a legally enforceable undertaking that the supplier or service provider will remedy any loss or harm arising from the contravention, an acceptable of liability and agreement to review their practices to ensure future compliance; 

-          Legal proceedings at Court. This is often utilised where the contravention is likely to have serious public implications.  At Court, various remedies are available including a declaration that there has been a breach, injunctions preventing the conduct in the future, an award of damages to consumers, pecuniary penalties, convictions and imprisonment. 

  • Undertake education programs; 
  • Work with other agencies to assist in achieving its objectives under the Act; and
  • Undertake studies and prepare reports on matters affecting consumers and competition.
