The National Quality Framework (“NQF”), operating under the Education and Care Services National Law Act 2010 and the Education and Care Services National Regulations, aims to nationally increase the quality of education and care provided in preschools, long day care centres, family day care and most care services operating outside of school hours by prescribing a Standard that needs to be achieved. The NQF is divided into the following seven “Quality Areas”:

  1. Educational program and practice;
  2. Children's health and safety;
  3. Physical environment;
  4. Staffing arrangements;
  5. Relationships with children;
  6. Collaborative partnerships with families and communities;
  7. Leadership and service management.

Services are assessed and provided a rating against each Quality Area and are then provided with an overall rating. These ratings are subsequently published online through the Australian Children’s Education and Care Quality Authority which oversees the NQF.

Some of the changes that have been implemented with the NQF include improved educator to child ratios, increasing the skills and qualifications of educators and to provide better support for children’s learning and development through approved learning frameworks.

Regulatory and/or legal action may be taken against services which are not compliant with the NQF. If you have received a compliance notice and/or direction or are being prosecuted for contravening your statutory obligations, our team at Navado can provide you with advice as to your available options and provide you with legal representation. We can also provide you with guidance on the legislative and regulatory requirements of your child care centre and recommendations for ensuring future compliance.
