In New South Wales, the Government has introduced strict laws to help combat street racing and ‘car hoon’ behaviour. Essentially, the relatively new laws set out that those drivers who are irresponsible and treat the roads as their own personal race track will be punished and that their behaviour on the roads will not be tolerated.

‘Car hoon’ offences include:

  • Street Racing
  • Burnout offences
  • Engaging in a Police pursuit
  • Speeding by more than 45km/ph over the legal speed limit

‘Car hoon’ offences can apply to other people other than the driver of the vehicle. For example, the aggravated burnout offence can apply to a hoon driver’s friend or associate who participates in, or urges others to participate in, films or photographs, promotes or organises hoon activities. The friends or associates of the hoon can be charged and face the same penalties as the driver of the vehicle.

Number plate confiscation

If you commit an offence that is classified as a ‘car hoon’ offence, the Police can confiscate your vehicle number plates at the roadside as an alternative to impounding your vehicle. The Police have the power to confiscate your number plates for a period of three (3) months. However, your vehicle may still be impounded for a period of three (3) months if you commit a ‘hoon offence’. If your number plates are confiscated, or your vehicle is impounded, you can apply to the Local Court for the early release of your confiscated number plates or vehicle that has been impounded.

There are also strict penalties that apply, if you use your vehicle after the number plates have been confiscated. Offences include driving your vehicle with no number plates, or driving it with false number plates.

Immediate licence suspension

Police have the power to immediately suspend your driver’s licence ‘on the spot’ if you are charged with an aggravated burnout offence or a street racing offence. The suspension of your driver’s licence will be in place until the offence you have been charged with is heard by the Court. 

Crash testing by Roads and Maritime Services

The law provides that if you are a repeat offender of car hoon offences that your vehicle may be forfeited to the State. Generally, vehicles that are forfeited are sold and the money is used to pay for storage and collection costs of the vehicle. Further, the law allows in certain circumstances for forfeited vehicles to be given to the Roads and Maritime Services for use in crash testing.

The Government and general public take a very serious stance against car hoon and the offences and their corresponding penalties reflect this stance.
