Reckless Driving

Broadly speaking, the basis of the offence of reckless driving is not only driving without due care and attention, but also driving in a way that can create a risk that is both an obvious risk and a serious risk of causing injury to any other user of the road or in a manner that would cause substantial damage to another person’s property. 

The maximum penalties for the offence of reckless driving include:

  • A minimum disqualification period from holding a drivers licence of 12 months (or 3 years in the absence of a specific Court order),
  • An unlimited disqualification period as a maximum, 
  • A maximum fine of $2,200,
  • A term of imprisonment of up to 9 months.

Predatory Driving

The offence of predatory driving is both a criminal and traffic offence. Behaviour that may be considered predatory may include, highly aggressive driving, road rage and tailgating. Road rage can take many forms and can include behaviour such as gestures, verbal abuse and to some degree driving in a manner that is aggressive. Whilst these behaviours in and of themselves may not be against the law, where this type of behaviour begins to threaten a person with physical harm the behaviour may be classed as predatory driving.

Section 51A of Crimes Act states: 
            A driver of a vehicle who, while in pursuit of or travelling near another vehicle:

                        (a) engages in a course of conduct that causes or threatens an impact involving the other vehicle, and

                        (b) intends by that course of conduct to cause a person in the other vehicle actual bodily harm,

            Will be guilty of the offence of predatory driving and liable to imprisonment for 5 years
