In general terms, Land tax is the tax that is levied on people who own land in New South Wales as calculated at midnight on 31 December of each year. Broadly speaking, land tax is not payable on your home (being your principle place of residence) or land that is used for primary production (a farm). In New South Wales, you will generally be liable to pay land tax where you own or partly own:

  • Land where a house, flat or residential unit has been built;
  • A holiday home;
  • Vacant land;
  • Rural vacant land;
  • An investment property;
  • Your share in a company title unit;
  • Commercial property (for example a factory, shop or warehouse);
  • A residential unit;
  • A commercial or industrial unit (which can include ownership of a car space); and
  • Land that you lease from the State or the Local government.

If you feel that the valuation on your property is inaccurate and you have received a land tax assessment that does not represent the true value of the property, we recommend that you speak with one of our land tax lawyers as you may be able to lodge an objection to the land tax valuation. There are strict time limits in which you must lodge an objection. Currently in New South Wales, you have 60 days to lodge an objection with the Office of State Revenue in relation to your land tax valuation.
