A motor vehicle accident (“MVA”) claim is a claim made following a motor vehicle accident. The claim may be a:

  • Compulsory Third Party (“CTP”) Claim where a person has sustained injury or has died as a result of the MVA; or
  • Claim against the Comprehensive or Third Party insurance held over the motor vehicle with respect to property damage.

Claims can be made against the at-fault driver’s insurance who may then decide whether or not to accept liability for the claim. Should liability or the quantum of the claim be disputed, legal proceedings may be commenced.

Claims against a CTP Insurer are subject to very strict procedural guidelines. It is very important that claimants understand the processes involved in their claim.
