Causes of action relating to property damage can be complex matters. These often involve disputes as to the cause of the damage, for which expert assessment may be necessary. An expert will usually inspect the damage and prepare a report which sets out their opinion as to the cause of the damage or the factors contributing to the damage.

Similarly, the extent of damage may also be in dispute. This involves a consideration of the cost of repairing the damage or otherwise replacing the property damaged, where possible. This issue may also be a consideration for an appropriate expert.

If someone is aware that they are causing damage to your property, do so deliberately or recklessly, they may be liable to you for that damage. You however, are under an obligation to mitigate the damage. This involves taking reasonable steps to attempt to minimise the damage caused. A failure to do so could be relied upon by the other party to reduce any damages which they are required to pay.
