Migration Visas:

Overview FAQs Articles Locations

Our Migration Lawyers can assist you in the area of Migration Visas and can provide you with competent legal advice in a timely fashion.

Generally, if you intend to remain in Australia, you will need a Migration Visa. The Migration Visa that you will need to apply for will vary depending on the purpose of your stay.

The two most common Migration Visas are:

  • Family Sponsored Visa; and
  • Skilled Migration Visa.

Family Sponsored Visa

An eligible family member residing in Australia may be able to sponsor another family member who is outside of Australia to come to Australia. The requirements for a family sponsored visa vary depending on whether the visa is temporary or permanent. For example, where an eligible person intends to sponsor their father or mother, one of the requirements that the parent must prove is that a majority of their children reside in Australia. This means that if a parent has three children and two of them reside in Canada, the parent would be considered ineligible for a family sponsored visa.

Our Migration Lawyers are familiar with the different family sponsored visas and will be able to advise you on your eligibility. Depending on your circumstances, our Migration Lawyers will provide you with the appropriate visa class and explain the conditions and restrictions imposed by the visa.

Skilled Migration Visa

The other most common method in which a person may be able to migrate to Australia is by showing that he or she has a skill that will make a positive contribution to the Australian economy. A person who may be able to show that they possess a relevant skill will be able to apply for a Skilled Migration Visa. There are various classes of Skilled Migration Visa to accommodate different situations and circumstances.

There are additional requirements the applicant will need to demonstrate including a competency in the English language and possess the relevant qualifications. The applicant must also be under the age of fifty (50). To discuss your options for a Skilled Migration Visa, speak to one of our qualified Migration Lawyers.
