Citizenship:

Overview FAQs Articles Locations

An Australian Citizen refers to a person who is a formal member of the Australian body politic, with such rights and obligations as that status entails. The Constitution gives the Commonwealth Parliament the power to enact laws with respect to “naturalisation and aliens” and “immigration and emigration”.  Central to the rights of any state is the right to control who can enter and remain within its borders. The right to permit entry to, or expel aliens from Australia is derived from this principle of sovereignty and is enshrined in the Australian Constitution (the Constitution). The concept of citizenship, though not constitutionally defined, is central to the idea of the Australian body politic; and to the way the Australian community defines itself for the present and the foreseeable future. You can become an Australian citizen by descent, birth or marriage.  Alternatively, you may be granted citizen status if you fulfil the obligations and requirements necessary with the Immigration Department.  Comprehensive legal advice from an Immigration Lawyer may be advantageous to ensure that you have a good understanding of these matters.

Australian citizenship is a privilege that offers enormous rewards. By becoming an Australian citizen, you are joining a unique national community.  Australia has been built on the combined contributions of our Indigenous people and all those who later travelled and settled in the country. Australia is a vast, diverse country which is simultaneously a unified and harmonious nation. Becoming an Australian citizen means making an ongoing commitment to Australia and all the values that it stands for as a democratic, free country. It is also the beginning of your formal membership of the Australian community. Comprehensive legal advice in from a skilled Immigration Lawyer may be of great assistance in understanding these rights and duties.

As an Australian citizen you have the right to vote in federal and state or territory elections, and in a referendum, apply for work in the Australian Public Service or in the Australian Defence Force, seek election to parliament, apply for an Australian passport and re-enter Australia freely, access to government benefits and assistance  and register children born overseas as Australian citizens by descent. As an Australian citizen you have duties that include to obey the law, defend Australia should the need arise, serve on a jury if called to do so, vote in federal and state or territory elections, and in a referendum. Solid and detailed legal advice in from an Immigration Lawyer may be of great assistance making an application for citizenship.

Australian citizenship has enormous benefits because it is a nation which has a stable system of government and Australians respect the authority and laws of the government. Our stability, our culture and our laws have been shaped by our history. By joining the Australian community, you will inherit this history and you will be in a position to contribute to it.
