The Health Care Complaints Commission is a New South Wales Government body whose role is to protect the public’s health and safety by dealing with complaints about persons who work in the health profession and/or at heath care facilities.

The Health Care Complaints Commission is required to assess complaints, assist in the resolution of the complaint, investigate those complaints of a serious nature and release a final decision about the complaint, eg whether a medical professional should be prosecuted. Prosecution may be brought in the New South Wales Civil and Administrative Tribunal, hereafter NCAT.

In broad terms, there are various reasons persons may make a complaint to the Health Care Complaints Commission, such as:

  • Unsatisfactory professional conduct;
  • Professional misconduct;
  • Misdiagnosis;
  • Prescribing incorrect treatments;
  • Inappropriate relations with patients;
  • The competency of the medical professional, for example, psychological disorders or drug dependency.
