A Correctional Patient, is a person suffering a mental condition or illness that is serving a prison sentence or is on remand. Generally, Correctional Patients are transferred from a correctional centre to a hospital where they are usually given treatment and/or medication.
When considering each Correctional Patient, the Mental Health Tribunal is required to carry out a review of the individual. These reviews usually determine whether or not an individual is to remain in hospital and therefore be considered a Correctional Patient, or if an individual is found not to be suffering from a mental illness or mental condition, then they are required to be sent back to a correctional facility.
If a person has been considered a Correctional Patient, the tribunal must review the patient every six months. These reviews may result in the patient:
- Becoming classed as an Involuntary Patient and being required to remain in hospital;
- Being released on a Community Treatment Order; or
- Sent back to a correctional facility.
