An online presence for your company, business, association, club or organisation is essential in today’s world. With the population of those who conduct research, transact business and otherwise deal with entities via online and internet technology which is constantly growing, having a clear and recognizable web presence can be one of your most important assets. One of the most obvious of such assets is having a secured domain name. The domain name will form the basis of your website address and email address, and as such, will carry your goodwill and corporate or organizational identity wherever it is viewed. Ordinarily, the domain name will therefore be your company’s trading name, your organisation’s registered name, or a truncated version of either. The “.au Dispute Resolution Policy”, known by the abbreviation of auDRP, is a system that facilitates the resolution of disputes relating to domain names in Australia between registered domain name owners and those who purport to have a competing right in that domain name. The process is a local adaptation of the “Uniform Domain Name Dispute Resolution Policy” formulated by the Internet Corporation for Assigned Names and Numbers. The auDRP is intended to be more economical and efficient and thus more affordable to domain name users. The process is outlined in the policy document and procedural rules. These can be difficult to navigate to a layperson and Navado Lawyers and Solicitors can assist in any claims and objections being ventilated through this dispute resolution process.

Brand protection is essential for any company, whether it is just starting to trade or is an established business. The company brand carries with it the identity of the business and is associated with the quality of the product or service that is synonymous with the company’s reputation.

Protecting the brand is achieved through effective trademark registration and corporate structuring so that the brand is safe from infringement and secured in times of financial or economic turbulence.

There are many legal issues and matters to consider, surrounding the registration and use of internet & domain names.  Many of these legal requirements are statutory, however; as matters are litigated before Courts, judicial decisions are made that which will impact on the way that legislative terms are interpreted. This can be a heavily fact and evidence based exercise and it may be difficult, or even impossible, to derive a strict rule that can be applied with mathematical accuracy for each and every case that arises.
